The INPI (the Brazilian Patent and Trademark Office), announced approximately a month ago, changes that will be introduced in its Schedule of Official Fees. The changes, which go beyond the simple increase of the fees unaltered since 2014, were proposed by the INPI and have already been approved by the Ministry of Industry, Commerce and Development (through Resolutions GM\/MDIC no. 110\/2025 and INPI\/PR no. 10\/2025).<\/p>\n
A few changes will be implemented in the rules for payment of some services, the most controversial being the one that eliminates payment of final fees for granting of trademark registrations and of patents, currently charged when allowance of the corresponding applications is published. The elimination of the said fees will be compensated by a higher value of the filing fees. The changes of the INPI official fees will be introduced in different steps, on August 7, September 20, and December 20, 2025.<\/p>\n
The INPI is encouraging applicants not to pay the final fees for trademark applications allowed as from June 24, 2025, as well as for patent applications that will be allowed as from September 23, 2025, under the rationale that such fees will not be due after September 20 and December 20, 2025, respectively.<\/p>\n
Our firm, however, recommends applicants pay the said fees, in order to be in a safer legal position, considering that the current INPI Schedule of Fees, which is in accordance with the IP law in force, requires payment of the same. On the other hand, currently there is a lot of uncertainty as to whether or not these changes and fees increase, which might be challenged before the courts by the local IP associations, will enter into effect.<\/p>\n
As soon as these changes actually enter into effect, the referred-to payments might not be made, according to the new policy adopted by the INPI.<\/p>\n
In order to help our clients to afford the new value of the INPI fees, we will keep charging the filing fee and the final fee separately, the latter when the allowance of the trademark or patent application is published in the official bulletin.<\/p>\n
For your ease of reference, attached you will find a table with the new values of the INPI fees for trademarks and patents, and the dates on which the same will enter into effect. The following is an example relating to trademark and patent filing and final fees:<\/p>\n
