The Brazilian PTO (BPTO) published in your Official Gazette 2739 of July 04th, 2023 the ordinance/BPTO/PR No. 25 which provides for the registration of industrial designs under the Hague Agreement.
The Hague agreement aims to speed up and facilitate procedures for registering industrial designs abroad and reduce the costs involved in this procedure. The agreement allows residents of a member territory to request protection for their industrial designs in all signatory countries through a single application: an international registration application.
The request for international registration of an industrial design, through the Hague Agreement, must be filed together a International Secretary of the World Intellectual Property Organization (WIPO) or with one of the offices of the contracting parties able to receive such requests. Each country will make its analysis and relation to the requests for Industrial Designs made based on the treaty.
Bringing benefits like other international protection agreements related to industrial property, such as the Patent Cooperation Treaty (PCT) and the Madrid System for trademarks, the Hague agreement will facilitate industrial design creators who seek exclusivity of their design in the international market.
The agreement provides international protection in 96 countries with just one filing. The agreement will enter into force in Brazil on August 1st, 2023, at which time the National Institute of Industrial Property (INPI) will begin to receive applications for Industrial Designs via the Hague System.
