Formalization of Accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Dear Colleagues,

Further to our letter from last year, we now inform you that, on June 10, 2026, the President of Brazil formalized, through Decree n°. 13,011/2026, Brazil’s accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure.

As previously informed, the Brazilian Patent and Trademark Office (INPI) shall act as the national authority responsible for procedural coordination under the Treaty and is expected to issue supplementary guidelines for the acceptance and recognition of microorganism deposits.

Having signed the Treaty, Brazil can now apply for recognition of its national institutions by the World Intellectual Property Organization (WIPO) to act as International Depositary Authorities (IDA), receiving, storing, and providing this biological material in accordance with the Treaty’s rules. Brazilian institutions, such as Embrapa and Fiocruz, are already mobilizing to be recognized as IDAs soon. Currently, the only IDAs in Latin America are in Mexico and Chile.

The formalization of the accession to the Treaty boosts technological development and the competitiveness of biotechnological innovation in Brazil and strengthens the country’s position as a reference in the conservation and sustainable use of genetic resources.
